SCOTUS RULES TWICE THAT LAW MEANS NOTHING



The history of our country and its fidelity to our Constitution that protects inherent natural rights that no human or man-made mechanism ever authored, controls or has the hubris to deny the people just evaporated out of thin air a few days ago by the Supreme Courts rulings.

Federal tyranny that was so feared by the opponents of establishing a federal government (anti-federalists papers) argued that a centralized beast would not be contained by constitutional constraints. They contended that expecting adherence to the law was not enough protection for the people's rights knowing the egos of mankind and that in time central authority would devise rationale to allow it to operate outside the scope of its defined boundaries.

The Supreme Court in its marriage decision has effectively ignored their oath to our Constitution, ignored the history, purpose, intent and the complete ideology of American liberty. No longer are they content to be a referee interpreting the law to keep all sides honest to our founding principles, they have empowered to themselves without any authority the right to rule, dictate and most deliberately to disregard their oath to uphold the Constitution.

The 14th Amendment according to the court has trumped the Constitution. The ruling has effectively silenced and castrated the Bill of Rights' while opening the door for the court to tyrannically moralize American values it deems unacceptable regardless of the will of the people.

If the court wanted to grant legal status to gay marriage it could have ruled that all states needed to provide an equivalent to marriage in legal status such as civil union. In fact, most states already offer that provision. But instead, in an act of not just unconstitutional abandonment of oath, but as false gods, they arrogantly ruled a new definition to an historic religious union that pre-dates the modern world.

It is not just legislative activism it is far more troublesome than that, it is a denouncement of everything this nation fought and died for when we established a Democratic Republic in which WE THE PEOPLE are not governed by omnipotent dictators but rather govern ourselves.

Equally in the courts upholding of the ACA law we note a glaring inconsistency of how law was previously adjudged. For any jurist or lawyer to be able to redefine the meaning of words in order to win a favorable result, makes not only mockery of the law but reduces the power of law for any plaintiff or defendant seeking the words of law to assign them justice.

No justice can be had if law is interpreted by a mere siding of intent by a jurist to one party over another regardless of the language in a contract. When the legal language loses its invincible black and white power of arbitration then all people lose the ability to seek redress from swindle.

The checks and balances of our three branches of government have been exposed to be a sham of collusion rather than defenders of our constitutional Republic. The American people have tried to elect representation that honors the pledges and promises they make on the campaign trail only to find that once elected, they instead ignore their constituents while they sit on the lap of corporate and Wall Street lobbyists, whoring our liberties for personal and party wealth.

What we as Americans should find most offensive about these latest rulings by a politicized court is the useless notion that new law will remedy lawlessness.

Another Amendment to the Constitution? Really, so the court can ignore it, in the same careless disregard as they have the 9th and 10th Amendments? Or a repeal of Obamacare that would do nothing to protect against future odious laws passed by the legislature and upheld by a legally blind court? A new marriage contract named God's Covenant that excludes the state from participation? Surely they will find a way to evince state power over private endeavors of liberty, that is what Obamacare did, forced individual citizens to buy a product.

There is really is only one remedy now for the people. Nullification by the states and civil disobedience until sanity returns to office holders.
It seems ironically eerie that we are in the midst of a debate about the banning of the Confederate flag, which in any thorough reading of the conditions set before the Civil war was as ripe for a peaceful outcome to the slavery issue rather than the destructive outcome yet that is what a corrupt Congress allowed to manifest in 1861.

The south had conceded the moral ground ideological on slavery years before succession and implored and impeached the Congress to help them end slavery in a way that was not economically punitive on the southern states alone. They asked for grandfathering, they asked for price controls on their farm commodities and they asked for federal education money to supply freed black slaves with trades and skills.

All of these proposals were reasonable and yet unreasonably rejected by a corrupt Congress lobbied and bribed by wealthy textile manufactures that wanted to lower their commodity costs by hoping plantation bankruptcies would allow them to buy these farms and exclude the middle men. The south argued that slaves to be freed should be counted in the census to afford the south more Representatives in the House than they currently were allotted so as to arrive at a fairer national sacrifice to the whole country that shared the guilt of national immorality.

All proposals were denied causing succession and the Civil war that killed many Americans needlessly.

Today, we have a Congress completely beholding to globalist corporate interests, an Executive branch that re-writes laws by executive order and fails to enforce laws it ideological disagrees with in a blatant abuse of power, while the Supreme Court has made recent political not legal decisions as immorally incomprehensible and reprehensible as the Dred Scott case of 1857. The majority of the judges on that court were pro-slavery when they ruled that a free black man was not considered an American citizen. Which is why we have a 14th Amendment (1868) precisely to correct a monumentally flawed Supreme Court decision.

Who would have imagined that 147 years later the 14th Amendment would be used by the court to redefine marriage and silence the voice of the people's referendums on a long standing moral and religious institution with not righteousness but against the creator's intent.

This decision is not just wrong from a ideological debate, it is as wrong a precedent against State Right's, individual rights and America's whole democratic Republic structure created to insure usurpations of authority would not trample people's liberty and independence from state control.

For those liberals espousing this decision as a celebration of democracy, take note, this wrong minded decision was made by five unelected jurists that struck down the duly cast ballots of real democracy by throwing away the results of our State referendum process and nullifying the votes of millions of citizens.

If this time you agree with a court, that trashed the majority opinion, ignored our federalism, usurped a power not enumerated to them and decided above the will of the people, will you also agree to the next encroachment by government ruled by that same court that tramples your beliefs?

Perhaps maybe in the near future if this un-tethered to the Constitution Supreme Court, decides that your right to privacy is so limited, it allows the government to place camera's in your home under the guise that the state needs to defend you from terrorists? Will you be waving in approval then?

IT'S FAIR MARKETS NOT FAIR TRADE



On both sides of the aisle there are supporters for the TPA Trade Promotion Authority (Fast track) and the TPP Trans Pacific  Partnership that has Americans confused. Especially given the dysfunction of our current political logjam it is curious to see unlikely bedfellows so cozy and comfortable on this trade issue and worse to have conservatives secretly applauding Pelosi.

The TPP or trade deal has Australia, Brunei, Canada, Mexico, Brazil, Chili, Peru, Vietnam, Malaysia, Japan, Singapore, New Zealand and the United States in a trade partnership but is it a good deal or a negative deal for Americans? We don't know and that's the biggest problem.

There seems to be four realities to global trade deals, one, is that all parties invariable cheat or ignore the terms of the deal. Two, America is always left in a trade deficit in which much more foreign product is imported and less American product is sold in foreign markets usually thru currency manipulation. Three, there is never any effective or realistic arbiter to enforce that all parties stick to the deal. Last but not least corporations and K Street benefit far more than America's main street. Why? Because our market is political corrupt and not a free market anymore.

The problem with this latest deal is that the President has been pushing for TPA or Trade Promotion Authority. In essence if TPA were passed it would give the President the ability to present to Congress a trade bill like TPP and ask for a straight up or down vote while not allowing for amendments or changes by our legislative process. 

Congress would be ceding its power to amend, re-write and fix trade deals by handing its power to the executive branch. It would give the President the ability to broker bad deals and then affront Congress with the, hard place and a rock choice, of dammed if you do dammed if your don't, by passing a bad deal or seeing China step in and take our place. 

This Trans Pacific Partnership deal has been euphemized as "Obamatrade" because America's level of government distrust is at an all time high given the amount disingenuousness emanating from the White House. Furthering the suspicions of the American people is the hushed secrecy of the deal coupled with a President and Congress that has failed to explain the terms of this trade alliance to the American people. 

It therefore appears to be just as onerous a treaty, as Obamacare was as a Bill, where an expansive law was passed before anyone read the provisions, especially the ones in the ACA that ceding legislative authority to the bureaucracy of the Health and Human Services Secretary to make up and write regulations as wanted or needed. If this trade deal is so important, and ensures American products are treated fairly in these countries markets, why the secrecy? 

Free trade is a fact of life today and unless and until there is wide scale global recession or depression (not outside the realm of potential) like it or not American products must compete on the world stage. Being against this treaty or any trade agreement is not about being an economic protectionists or an isolationists but rather a realist. 

We know that in past free trade agreements some countries purposefully make American imports so economically unviable that soon there develops a big deficit in which a country's imports to our nation's consumers far exceeds our exports to their consumers. We complain, but do little to alter a growing deficit. It therefore is imperative to have a strong rules and an equally strong referee to ensure fairness in trade.

However, the imports and exports of products is only one aspect of trade agreements and some say even a phony issue, since free markets always contain ebbs and flows depending on consumer demand. The truth is that there is never a real parity ratio between trading partners within the normal free market of ups and downs or supply and demand, termed differently in trade as imports and exports or expanding trade markets and deficits.  

What real Americans worry about is job loss. That worry is not unfounded because corporate America has been just as underhanded and untrustworthy as the current Administration. The fact that corporate lobbyists are pushing hard for TPP raises suspicions with the American people. They also pushed hard for comprehensive immigration reform claiming America's education system was not providing qualified workers. Leaving people to wonder why they continued to donate to liberals that have ruined our education system.

America's corporate taxes and regulations are at an all time high under the micro management of progressive socialists that have strangled our once free enterprise marketplace, and worsened our current crony capital mixed market by continuing to move it into a state controlled market or (communism). 

Yet, how have the corporations responded to increased federal control? Have they lobbied to return us to a free enterprise marketplace? Have they supported free enterprise candidates to Congress? Have they campaigned against social progressive candidates? Have they refused to participate with Obama agenda? Have they lobbied Congress to decrease regulations so they could hire more American workers? Or have they participated and even furthered government involvement to benefit themselves in a selfish oligarchy scheme?  

We know that the big health insurers not only backed Obamacare they wrote the legislation. Why? To reduce the competition and rake in more profits.  The reason social progressive have become the party of big business is that they understand it is easier to control a few major players than to corral thousands of independent business owners.

Corporate America and K Street are in bed with both political parties for their own profit interest, period. If they can open up new plants in Vietnam or Chile and take advantage of low wages and low benefits while reaping greater profits, does anyone think they won't take advantage?

Democrats are fond of fooling their voters by saying they are the party of the people, the little people, not big business like oil companies, but is anyone buying that lie today? It is plain and obvious that both parties are in the deep pockets of corporate and K street donations. 

Both political parties are fooling Americans when they claim to be pro business when really they just want to continue to line their own pockets with wealth and a cash cow to tap for funds from an outrageously growing world of political campaign spending. 

If the GOP in Congress were to get back to their real party platform, of being pro free marketers rather than corporate shills, they will need to support not just lowered corporate tax rates but fair regulations for large and small business, fair and free market trade competition both home and abroad. They should be considering serious slashing of federal agencies along with auditing the fed and returning America to a wealth rather than debt based economy. 

If Americans believed that our government was on the road to restoring our free markets and once again becoming an asset based economic power, ridding us of the handicaps place on us by social progressive micro regulatory rules, then we would confidently be in support of any and all global trade deals. America has never been afraid of competition. Get off our backs and bring it on and we'll do just fine.

MEGA DATA COLLECTION WITTINGLY DANGEROUS



Whatever you think about the Patriot Act, as to whether it crosses the line or stays within the boundaries of the Constitution's  Bill of Rights' protections, one thing is clear, mega data unwittingly collected but allowed to be stored by our government is obviously an infringement.

When Director of National Intelligence James Clapper claimed that NSA was "not wittingly" gathering data on innocence citizens, he not only lied but failed to disclose that the government was also saving that tangential private data. 

Why is our government allowed to keep this collected mega data?  Why aren't more conservative Republicans amending the Patriot Act and introducing legislation that protects the rights of citizens from government intrusion?
It seems that only Senator Rand Paul is talking about the need to reform this un-patriotic Act, but then again, Paul supported Mitch McConnell's re-election campaign in Kentucky, so they both seem to be licking the same Utah salt.

The line between private and public papers is being blurred by technology, abused by government, corrupted by elites and ignored by our courts. Hillary Clinton uses a private e-mail account and server to conduct official State Department business (illegal) while innocent citizens within range of an NSA spying operation have their cell phone data swept up and then stored by the government. Hypocrisy or downright Big Brother corrupt tyranny? 

Sitting out in Bluffdale, Utah is an NSA facility called the Intelligence Community Comprehensive National Cybersecurity Initiative Data Center or if you prefer the shorter name, the Utah Data Center.

This huge facility holds all the warrantless, unconstitutional seizure of citizen's phone and e-mail records in  brazen violation of Americans 1st and 4th amendment rights. In what can only be termed astounding arrogance, NSA wants Americans to believe that it collected this data unwittingly and  is not reading the personal information it has collected, all while storing citizen's ill-gained personal correspondence in a classified facility. Why?

I think the hills are alive with the sound of muzak. 

"Do, a tale of insincere, Re, a pocketful of lies, Mi, a name WE call ourselves, Fa, a long, long way from truth, Sol, a whole cloth made of fraud, La, our representatives support for Sol, Ti, a drink to jam our heads, that will brings us back to Do, or duh a tale of insincere."

We have been told that the reason innocent people's cell phones were tapped was because the spying technology is so sensitive it picks up the electronic data from a wide swath area beyond the targeted subject. Therefore, "unwittingly" was the term used for why the agency was capturing and collecting innocent American's private information without  their consent or a court warrant. 

We have been further assured that the agency is not reading the warrantless material that it snatched up in its eavesdropping trawler's net, because they claim they are not. Wow, now that's a gold standard of assurance, is it not?

Which of course brings us back to DO, a tale of insincere. For if the government claims it harvested our private data tangentially and is not using it to spy on innocent Americans, then why is it not destroying it, rather than storing it? 

Fisherman using nets routinely  find many different species they are not hunting, unwittingly caught among their intended catch, so what do they do? Keep them, or throw them back into the ocean? 

If you believe that NSA is being honest and not prying into data it collected without a warrant (naive is an inadequate description of your trust level) consider what might happen in the future, given what we already know has happened in the past with agencies holding sensitive information, like the Internal Revenue Service.

We have seen private information passed around by our government from conservative groups to social progressive groups by an IRS that targeted and harassed taxpaying Americans. These targeted American groups' crimes were merely to be in political opposition of the current administration and seeking to restore honesty and integrity in our political process (TRUE THE VOTE). Yet to date, no one has been prosecuted, no one has been charged, and recent news reports have charged that the targeting continues at the IRS.

But hey, if you are a lawful American citizen, committing no crimes and loyal to your country, why should you fear or care if your government has a cache of personal information about your life held in a classified computer facility, in a Utah, city called Bluffdale between Step and Sheep mountain? (The factual names are so metaphorically accurate you might think I made them up, I didn't.)

So considering that you are a law abiding citizen and in the interest of capturing terrorists, you support the NSA program and think you can trust that your government, then ask yourself; exactly what protections are in place for the government to not turn its focus on you?

Today, he is far more vulnerable than ever before to being caught up in a criminal investigation and prosecution — and to actually being convicted and punished as a criminal — for having done something he did not even suspect was illegal."

More and more we are not only seeing an explosion of laws by our federal and state government but an unmistakable, undisguised and completely brazen political corruption of our justice system. If you belong to the politically correct group, have the political correct pedigree and are part of the elite power peddlers then you are safe from prosecution. Everyone else that is not included on that safe list is fair game and vulnerable.

You might also ask, is that mega data safe from foreign hackers that could use that megadata information for identity theft? Do you think given the revelation recently that both the White House and the State Department computers were hacked that the computers storing data at the NSA would be safer? What about another Snowden, another spy slipped into the NSA with classified clearance but this time with far more sinister plans?

Americans have the right to use the latest technology under the assumption that private stays private. Just because this technology makes it easier for the government to ensnare us without breaking into our homes without a warrant, doesn't mean they should, nor does it mean that Americans must go off the grid to protect their privacy. We need to reform the Patriot Act.

The First and Fourth Amendment in our Bill of Rights has no expiration date, wittingly or unwittingly Congress must uphold our Constitution!

MO MO MO MONEY!



If you ask big government lovers what the solution is to every incompetent, corrupt and dangerous practice exercised by the federal government, the answer is always the same: they need more money.

Never does the government-loving left ever admit a federal program or agency might be counterproductive, expedient or ineffective. They hold on to their federal bureaucracies as though they are precious keepsakes passed on from their beloved ancestry.

Also in keeping with their complete unabashed shameless hypocrisy they fail to see the irony of calling themselves "progressives" when they instead support the propping up of old failed policies while stifling progress and innovative change.

The recent Amtrak train crash is illustrative of the Democrat's recalcitrant and nonsensical argument that always is intoned to the ears of a "Gruberite" crowd. They argue that if those big bad Republicans just gave Amtrak more money, then the engineer that allowed the train to travel 106 mph on a track curve in Philadelphia rated for 50 mph, the disastrous crash would not have happened.

Obviously lowering Amtrak's federal subsidies was the reason for the crash, right? Obviously giving Amtrak all the money it requests would insure that there would never be another train crash, right? Obviously, if every federal agency and program was fully funded then government would be efficient, honest and make all our lives better, right?

Wrong is the correct answer, of course, but it brings up an interesting question. If this logic is so obviously ridiculous why, and better yet who, is being influenced and swayed by this constant barking of bunk by the left? A better question still, might be to wonder why they always need a punching bag? 

Of course no sane person would buy this  irrational response, but the left isn't trying to provide answers anymore, instead they are selling blame. Theirs' is a political "gotcha" game that points fingers at the liberal's Bogeyman; named Republicans.  

It has become such a nasty naked political trick for the left, that they have lost any faint hue of shame in parading their farce. The factual truth that their liberal policies have failed, time and time again, is the real bare bottomed embarrassment that causes them to lash out at conservatives rather than suffer self-reproach.

Recently the President made an incomprehensible accusation, that FOX news depicts poor Americans as lazy and undeserving. The President in true left-wing form, made this broad bushed statement while citing no examples, referencing no particular segments and showing zero evidence that his perception drew on any substantive fact, save his own esoteric ideologically driven mindset. Well, of course, if the President of the United States says FOX news is full of classism then it must be a fact, right?

Wrong again, but this isn't about sane dialog and intellectual discourse, this is about deflection, blame shifting and avoiding having to admit defeat. Perhaps I failed to mention that the President made these remarks at a Georgetown University panel meeting to discuss poverty. Constructive criticism or destructive scapegoating? I will leave the you to judge. 

The Democrats have sold themselves as the savior of the poor since Lyndon Baines Johnson declared war on poverty in his "Great Society" programs. Head Start, food stamps and work study all came out of the Federal Treasury to ensure that poverty would be significantly marginalize. Year after year, decade after decade Democrats continue to roll out the taxpayer cash on these programs even when data suggests poverty is increasing. 

Even the dimmest bulb understands that eventually a government that operates on the backs of hard working taxpayers to fund its bloated weight will need to shift its policies and priorities or see itself implode.

So what is the alternative that today's Democrats have for us to consider? What are their new ideas and innovative suggestions as to how to slow the rise of increasing poverty and crumbling inner city decay.
More federal spending is the only idea that the liberal Democrats have to offer the American public.

This double down on failure Party, this blame game Party, this federal program hocking Democrat Party is exposing its indifference to the very victims it claims to support. For the only people rising up above poverty and becoming rich from the current liberal government welfare programs, are political leeches like Bill and Hillary Clinton not the inner city single mom.

Instead of more, more, more, money, Americans must start shouting enough, enough, enough!
